When one spouse is financially dependent on the other, Florida law provides for payment of alimony during and after divorce proceedings. Alimony is available to both men and women — there is no gender bias under Florida law. The foundation for any alimony award is the need of the requesting spouse and the ability of the other spouse to pay.
The starting point is the demonstrated needs of the requesting spouse and the other's ability to pay. Factors include incomes from work and passive investment sources, the reasonable needs of the requesting spouse, and what the paying spouse can afford. In some cases, income can be imputed if a spouse is voluntarily unemployed or underemployed. After July 2023, the maximum alimony is capped at 35% of the difference between the parties' net incomes, with duration presumptively limited based on the length of the marriage.
The relative incomes of the parties, a valid prenuptial or postnuptial agreement, and the lifestyle established during the marriage may all play a role in limiting alimony.
